Adem\u00e1s, se considera que el salario m\u00ednimo y su fijaci\u00f3n peri\u00f3dica constituyen un derecho social y fundamental para el crecimiento econ\u00f3mico y el desarrollo integral de la persona, dado que su objetivo esencial es cubrir las necesidades normales del trabajador.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Fundamentos Legales<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Constituci\u00f3n Pol\u00edtica de la Rep\u00fablica de Guatemala:<\/strong>&nbsp;El art\u00edculo 102, establece el derecho de los trabajadores a un salario m\u00ednimo que cubra las necesidades b\u00e1sicas del trabajador y su familia.<\/li>\n\n\n\n<li><strong>C\u00f3digo de Trabajo:<\/strong>&nbsp;El art\u00edculo 103 define el salario m\u00ednimo como la remuneraci\u00f3n m\u00ednima que debe recibir un trabajador por su labor, sin discriminaci\u00f3n alguna.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Procedimiento de Fijaci\u00f3n del Salario M\u00ednimo<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Comisiones Paritarias y Comisi\u00f3n Nacional del Salario M\u00ednimo:<\/strong>&nbsp;&nbsp;Integradas por representantes de empleadores, trabajadores y el Gobierno, estas comisiones analizan y proponen ajustes al salario m\u00ednimo.<\/li>\n\n\n\n<li><strong>Recomendaciones al MINTRAB:<\/strong>&nbsp;&nbsp;Bas\u00e1ndose en estudios econ\u00f3micos y sociales, las comisiones presentan sus recomendaciones al Ministerio.<\/li>\n\n\n\n<li><strong>Emisi\u00f3n de Acuerdo Gubernativo:<\/strong>&nbsp;&nbsp;El Organismo Ejecutivo, considerando las recomendaciones, emite a trav\u00e9s del MINTRAB, el Acuerdo Gubernativo que establece los salarios m\u00ednimos que han de regir en cada actividad o circunscripci\u00f3n 119 literal d) de la Constituci\u00f3n Pol\u00edtica de la Rep\u00fablica de Guatemala, as\u00ed como de los art\u00edculos 103, 104, 105, 112 y 113 del C\u00f3digo de Trabajo, se establece la fijaci\u00f3n de salarios m\u00ednimos a trav\u00e9s de un proceso formal y regulado. Este proceso tambi\u00e9n considera los lineamientos del Convenio n\u00famero 131 de la Organizaci\u00f3n Internacional del Trabajo, adem\u00e1s de los acuerdos gubernativos vigentes, como el n\u00famero 776-94 y el 285-2021.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Circunscripciones Econ\u00f3micas:<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>CE1:<\/strong>&nbsp;Circunscripci\u00f3n Econ\u00f3mica 1, correspondiente al Departamento de Guatemala.<\/li>\n\n\n\n<li><strong>CE2:<\/strong>&nbsp;Circunscripci\u00f3n Econ\u00f3mica 2, aplicable a todos los departamentos del pa\u00eds, excepto el Departamento de Guatemala.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\">Comisi\u00f3n Nacional del Salario<\/h2>\n\n\n\n<p>La Comisi\u00f3n Nacional del Salario es un ente asesor, conformado por representantes del Gobierno, trabajadores y empleadores, y est\u00e1 adscrita al Ministerio de Trabajo y Previsi\u00f3n Social. Su tarea principal es armonizar los salarios m\u00ednimos que regir\u00e1n en Guatemala cada a\u00f1o.<\/p>\n\n\n\n<p>Para hacer esta propuesta, se realizan estudios de diversos aspectos econ\u00f3micos y laborales que facilitan las apreciaciones de la evoluci\u00f3n de los salarios y su implementaci\u00f3n.<\/p>\n\n\n\n<p>Durante el proceso, se emiten opiniones de las Comisiones Paritarias del Salario M\u00ednimo sobre las Circunscripciones Econ\u00f3micas uno y dos, para las actividades No agr\u00edcola, agr\u00edcola y de Exportaci\u00f3n y Maquila, conforme lo establece el Acuerdo Gubernativo 285-2021 del Ministerio de Trabajo y Previsi\u00f3n Social, las cuales de igual manera est\u00e1n integradas por representantes del sector gobierno, trabajador y empleador. Estas comisiones analizan la situaci\u00f3n local y posteriormente env\u00edan un informe razonado a la Comisi\u00f3n Nacional del Salario.<\/p>\n\n\n\n<p>Con esta informaci\u00f3n, la Comisi\u00f3n Nacional del Salario emite recomendaciones finales, que luego traslada a otras instituciones, para que emitan la opini\u00f3n t\u00e9cnica y legal que corresponda.
